Criminal law governs conduct defined as an offence, the sanctions attached to it and the procedure by which those sanctions are imposed. The Turkish Penal Code No. 5237 sets out the elements of offences and the determination of sentence, while the Code of Criminal Procedure No. 5271 governs the course from the opening of an investigation to a final judgment.

Procedure and time limits bear directly on the outcome here. Review of custody and detention, statements and questioning, the gathering of evidence, submissions on the indictment and appeals to the regional and supreme courts are all subject to fixed periods. Conducting the defence from the first moment of the investigation avoids consequences that are difficult to repair later.
