Family law covers the formation and dissolution of marriage and the personal and financial consequences that follow. The Turkish Civil Code No. 4721 governs the grounds for divorce, custody and contact with the child, the categories of maintenance, and the winding-up of the regime of participation in acquired property.
Custody, maintenance, damages and the division of property are usually determined in the same proceedings as the divorce itself. The best interests of the child are considered by the court of its own motion, whether or not the parties raise them. In an uncontested divorce, drafting the protocol so that it leaves no room for doubt prevents later disputes.
